1. Acceptance of Terms

By accessing or using the CBI Care Network website (the “Site”) or any services provided by CBI Care Network (“CBI,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site or our services. If you are using the Site on behalf of a minor, you represent that you are the minor’s parent or legal guardian and accept these Terms on their behalf.

2. Nature of CBI’s Services

CBI Care Network is a care coordination and provider matching service. It is critically important that you understand the following:

  • CBI is not a medical provider. We do not diagnose, treat, or provide medical advice. All clinical decisions are made independently by the specialists in our network.
  • CBI is not a law firm. We do not provide legal advice or representation. We coordinate specialist access for patients, including those involved in personal injury cases.
  • CBI is not an insurance company or billing entity. We do not process insurance claims or handle medical billing. Financial arrangements are between the patient and their specialist.
  • CBI has no financial stake in case outcomes. We do not receive contingency fees, case settlements, or any compensation tied to legal outcomes.

3. Services for Minors (Under 18)

CBI provides care coordination services for patients of all ages, including minors. The following provisions apply to services involving individuals under 18 years of age:

  • Authorized representatives only: Referrals for minors must be initiated by a parent, legal guardian, treating physician, or attorney with proper authorization. Minors may not submit referral requests on their own behalf.
  • Parental/guardian consent: By submitting a referral for a minor, the authorized representative confirms that they have the legal authority to consent to the evaluation and any resulting care on the minor’s behalf.
  • Age-appropriate specialists: CBI will endeavor to match minor patients with specialists experienced in pediatric or adolescent TBI evaluation when available.
  • Website use: This website is intended for use by adults (18 and older). Minors should not submit personal information through the Site without parental or guardian involvement.

4. Referral Process & Independent Specialists

When you contact CBI for a referral, we match the patient with an independent specialist (“Quarterback”) based on clinical presentation, geographic location, and specialist availability. You acknowledge and agree that:

  • The specialist is an independent practitioner, not an employee, agent, or contractor of CBI.
  • All clinical evaluations, diagnoses, treatment plans, and referrals to sub-specialists are made at the sole discretion of the specialist.
  • CBI does not guarantee any particular clinical outcome, diagnosis, or legal result from the specialist’s evaluation.
  • CBI’s involvement ends once the patient is matched with a specialist. Ongoing care is managed entirely by the specialist.

5. No Medical Advice

The information provided on this Site — including content about traumatic brain injuries, concussions, symptoms, screening, and treatment options — is for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. Statistical information presented on this Site (including stroke risk data and TBI prevalence rates) is derived from published research and is provided for educational purposes.

Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this Site.

6. No Legal Advice

Nothing on this Site constitutes legal advice or creates an attorney-client relationship. Information regarding personal injury cases, documentation, insurance defense strategies, and litigation is provided for general informational purposes to help attorneys and patients understand the value of clinical documentation. You should consult a qualified attorney for advice specific to your legal situation.

7. User Responsibilities

By using this Site and our services, you agree to:

  • Provide accurate and truthful information in all forms and communications.
  • Not submit referral information for individuals without proper authorization.
  • Not use the Site for any unlawful or unauthorized purpose.
  • Not attempt to interfere with the Site’s operation or security.
  • Not scrape, copy, or reproduce Site content without written permission.

8. Financial Terms & Billing

CBI’s service of matching patients with a qualified TBI specialist is provided at no charge for qualified patients. However, the quarterback specialist’s coordination with other providers may be charged to the patient’s account as a billable professional service. Medical evaluation and treatment services provided by specialists in our network are also billable services. Payment options vary by specialist and may include:

  • Medical lien (for qualified patients involved in personal injury cases)
  • PPO health insurance
  • HSA/FSA accounts
  • Payment plans
  • Direct payment

Not all patients qualify for lien-based billing. Financial arrangements are made directly between the patient (or their representative) and the specialist. CBI does not participate in billing, does not process payments, and does not guarantee the availability of any particular payment option.

9. Intellectual Property

All content on this Site — including text, graphics, logos, images, data compilations, and software — is the property of CBI Care Network or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CBI Care Network and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • Your use of or inability to use the Site or our services.
  • Any actions, decisions, or omissions of independent specialists in our network.
  • The accuracy, completeness, or timeliness of any information provided on the Site.
  • Any unauthorized access to or alteration of your transmissions or data.

Our total liability for any claim arising from these Terms or the Site shall not exceed the amount you have paid to CBI (if any) in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Site and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. CBI does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

12. Indemnification

You agree to indemnify and hold harmless CBI Care Network and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in California. You consent to the personal jurisdiction of such courts.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated “Last Updated” date. Your continued use of the Site after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
